These official rules (“Official Rules”) apply to the University of Alaska Video Contest ("Contest") being conducted by the University of Alaska located at

This Contest is intended for participation by legal residents of the 50 United States and the District of Columbia who are at least sixteen (16) years of age at the time of entry.
1. HOW TO ENTER: You may enter by submitting a video that is original, no longer than three (3) minutes in length and in the English language. One entry per person. All entries must be received by 11:59:59 pm PT on January 30, 2008 to be eligible for entry into the Contest. The use of automated entry software is prohibited. If Entry includes music, entry must use only music provided by sponsor at the UA My Way site.
2. CONTEST DETAILS: This Contest starts 12:00:01 AM (Midnight) Pacific Time (“PT”) September 3, 2007 and ends at 11:59:59 PM PT January 30, 2008 (“Promotional Period”). Go to www.uamyway.net anytime during the Promotional Period, click on the video contest icon and complete the online registration form by providing the information requested which includes without limitation personal information such as entrant’s name, mailing address, email address and phone number. Collection of entrants’ personal information shall be subject to Sponsor’s privacy policy, which is stated in #10 of these rules.
Videos entered in the contest should demonstrate what choices the University of Alaska has to offer and how entrants are impacted by all the choices there are to offer (“Video Challenge”). Information on the choices can be found on the website which can be found at www.uamyway.net, especially in the TV commercials about choices. Entrants may also go to www.Alaska.edu to find out more about the University of Alaska’s 430 certificate and degree programs, 16 statewide campuses, distance learning, exchange program, and campus housing options. Video entries must be submitted in the following video file formats: .MOV or .FLV or .WMV. The maximum file size for upload via a Brightcove CGM (consumer generated media) campaign is 100 MB and must be no longer than three (3) minutes in duration.
3. CONTEST RESTRICTIONS: The video submitted must be the original work of the entrant and must be owned by the entrant. The video must not have been submitted in any other competition or previously published (i.e., shown to anyone outside of your family or close friends). Modifying, enhancing or altering a third party’s pre-existing work does not qualify as entrant’s original creation. Video must be in keeping with Sponsor’s image and may not be offensive, as determined in the sole discretion of the Sponsor, nor can it defame or invade publicity rights or privacy rights of any person, living or deceased or otherwise infringe upon any person’s personal or property rights, including but not limited to, intellectual property rights. Sponsor’s right to use the entry shall not be restricted. Any entrant, whose entry includes the name, image, voice, picture or likenesses of a third party or element not owned by the entrant including without limitation the depictions of buildings, trademarks or logos (“Third Party Elements”), must be able to provide legal releases for use of all Third Party Elements by Sponsor in a form satisfactory to Sponsor at the time of prize notification or earlier at Sponsor’s discretion. Upon submission, entrant warrants and represents that any and all individuals appearing in entrant’s video submission have consented to appear in such video submission and entrant must be able to provide legal releases for use of all such individuals by Sponsor in a form satisfactory to Sponsor at the time of prize notification or earlier at Sponsor’s discretion. Sponsor will provide the appropriate release forms to winners at time of prize notification or earlier at Sponsor’s discretion.
Entries that are incomplete or do not comply with these Official Rules in any way are subject to disqualification. No correspondence regarding entries will be acknowledged or exchanged with entrants except as provided herein. Upon submission of an entry, entrant grants Sponsor the right to use, publish, adapt, assign, edit, dispose of, and/or modify such entry and the concepts and Third Party Elements embodied therein in any way, in any and all media whether now known or later developed, worldwide, in perpetuity, without limitation or approval by or compensation to the entrant or any other person and entrant may be required to sign a release to that effect at the time of prize notification or earlier at Sponsor’s discretion. Submission of an entry further constitutes the entrant’s consent to irrevocably assign and transfer to the Sponsor any and all rights, title, interest and claim including without limitation, all intellectual property, sales, and licensing rights which he/she now has or may have in the future, to the entry, and the concepts and Third Party Elements embodied therein. Entries will not be returned.
4. JUDGING: On March 1, 2008, judges will select the top five (5) scoring entries (“Winners”) from among all eligible entries received during the Promotional Period. The video entries will be judged using the following criteria: relevance to the Video Challenge (30%), entertainment value and creativity (30%) and technical execution and quality (40%) for a total of 100 points. In the event of a tied score, the entrant who received the most points for relevance to the Video Challenge will be declared one of the winners and in the event of a further tie, the entrant who scored the most points for entertainment value and creativity will be declared one of the winners. Only one person shall be identified as the winner for each video submission. The decisions of the judges are final and binding in all matters relating to this Contest. There will not be cash awarded as an alternative. The winner will forfeit their prize if they choose not to attend classes at UA.
5. PRIZES: Five (5) Prizes shall be awarded in total. Each prize shall consist of one (1) year’s undergraduate tuition at in-state rates, to the University of Alaska (defined as a maximum of 30 undergraduate credit hours in one academic year), not including room and board, books, student fees, meal plans or any other expenses (“Prize”). The Approx. Retail Value (“ARV”) of each Prize is $3,600. The total ARV of the five (5) Prizes is $18,000. No prize substitutions, transfer, cash equivalent or assignment of prizes allowed, except at Sponsor’s sole discretion. All taxes and other expenses associated with the Prize,including but not limited to graduate and/or non-resident tuition, and not specified herein are the Winner’s sole responsibility. If Winner is not admitted to the University of Alaska then Winner may still attend classes at the University of Alaska to use the prize. Prize use must commence by Fall semester 2010.
6. WINNER NOTIFICATION: On March 15, 2008, all potential winners will be notified by certified mail, return receipt requested. The return of any prize notification or prize as undeliverable or any other non-compliance with the Official Rules may result in the forfeiture of a prize and the selection of an alternate potential winner at the Sponsor’s sole discretion. Potential winners will be required to complete and sign an Affidavit of Eligibility and Liability Release, an IRS Form W-9, and where legal, a Publicity Release and provide other releases at Sponsor’s sole discretion, including without limitation, releases for all Third Party Elements and from individuals appearing in winner’s video submission, all of which must be returned within fourteen (14) days of issuance of initial prize notification or prize will be forfeited and awarded to an alternate potential winner selected from the remaining entries. If a potential winner is a minor, his or her parent or legal guardian must execute and timely return such documents to be executed by minor to Sponsor on the minor’s behalf.
7. LIMITATION OF LIABILITY: By participating in the Contest, entrants agree to release, indemnify and hold harmless Sponsor and its parents, affiliates, subsidiaries, advertising and promotion agencies, agents, representatives, officers, directors, shareholders, and employees (collectively, “Releasees”) from and against any injuries, losses, damages, claims, actions, or liability of any kind resulting from or arising from participation in the Contest or acceptance, possession, use, misuse or nonuse of any prize that may be awarded. The Contest and Official Rules shall be interpreted in accordance with the laws of the State of Alaska without regard to its principles of conflicts of law. Jurisdiction and venue and all disputes concerning the Contest shall be solely within the Superior Court for the State of Alaska in Fairbanks. Releasees are not responsible for computer, technical, printing, typographical, human or other errors relating to or in connection with this Contest, including without limitation, errors which may occur in the administration of the Contest, the announcement of the prize, the processing of entries or in any Contest related materials; or for transactions that are lost, stolen, late, misdirected, damaged, incomplete, or illegible entries or postage due mail; entries that fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, or process of any transaction therein. The Sponsor, in its sole discretion, reserves the right to disqualify individuals or void entries, to modify or suspend the Contest, or to terminate the Contest or a portion of the Contest, and to award no Prizes or such Prizes as it deems appropriate using all remaining eligible entries received as of the termination date. Should the Contest be terminated or modified prior to the stated expiration date, notice will be posted on http://www.alaska.edu/. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. As a condition of entering the Contest, entrant agrees that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; all causes of action arising out of or connected with this Contest or the Prize awarded, shall be resolved individually, without resort to any form of class action; and any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event shall cover attorneys’ fees. Sponsor reserves the right to modify prize award procedures. In the event of a dispute as to the identity or eligibility of a winner based on an email address, the winning entry will be declared made by the “Authorized Account Holder” of the email address submitted at time of entry. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
8. ELIGIBILITY: Contest is open to all legal residents of the fifty (50) United States and the District of Columbia who are at least sixteen (16) years of age at the time of entry. Employees of the University of Alaska, the Nerland Agency and their respective parents, subsidiaries, affiliates, prize suppliers and advertising and promotion agencies, and their immediate families (spouses, parents, children and siblings, and their respective spouses) and individuals living in the households of the above, are not eligible to enter or win. Void where prohibited by law.
9. WHO WON?: For the names of the Winners, available after March 15, 2008, go to www.uamyway.net or mail a self-addressed, stamped envelope to “University of Alaska Video Contest Winners”, Nerland Agency, 808 E Street, Anchorage, AK, 99501. Requests must be received no later than March 10, 2008. The Winners’ names will be sent when the drawing has been conducted and the Winners have been verified.
10. Privacy Policy:
The uamyway.net site is hosted on a commercial server for the University of Alaska. Information collected will be used by the University of Alaska and its contractors solely for the purposes of conducting the contest and communicating with the entrants about the contest.
Personally identifiable information you provide will not be sold or disclosed to other parties by UA or its contractors except as may otherwise be required by law.
We also collect information about your use of the site through the application of "cookies." This information helps us customize the Web site and allows us to statistically monitor how many people are using our site and for what purpose.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100 percent secure. As a result, we cannot guarantee or warrant the security of any information you transmit to or from the web sites.
